Ground breaking appeal in secondary victim claim for psychiatric injury challenging the principles in the ‘Hillsborough Disaster’ cases concerning secondary victims (Alcock v Chief Constable of South Yorkshire [1992] 1 AC 310). Claim for psychiatric injury by daughter of primary victim who suffered psychiatric injury by witnessing death of primary victim (her mother) who had been injured 3 weeks before in a workplace accident caused by insured’s negligence. In issue, whether insurers liable in ‘two-event’ psychiatric injury case: is proximity to original accident required or is proximity to the death 3 weeks later sufficient for liability to be established by a secondary victim?
