Barrister Mark Engelman triumphs in landmark intellectual property case: Intel Corp v CPM (UK) Ltd

The European Court of Justice gave its highly anticipated judgment in Intel Corp v CPM (UK) Ltd this morning which impacts upon the extent of trade mark protection conferred upon brand owners with reputation when seeking to rely upon dilution as a basis for attacking similar trade marks used in dissimilar areas of trade.

Hardwicke Building’s Head of Intellectual Property Mark Engelman successfully represented CPM (UK) Ltd in this 5 year long battle through the UK courts culminating in today’s judgment in the European Court of Justice.

The judgment requires brand owners whose marks are said to have been diluted to prove an economic effect upon the consumer. For more information please read the judgement here.
