The first level of defence to fraudulent claims has been erected with the increase in the Portal value and the establishment of fixed costs for those actions under £25,000.
Colm Nugent and Jamie Clarke take a look at the amendments to the CPR that accompanied the implementation of the Jackson reforms on 1 April 2013 and consider the new and existing tactical opportunities for defeating fraudulent claims at the interlocutory stage with tools such as costs budgeting, the revised part 3 and wasted costs. The talk will also consider the concept of “fundamentally dishonest” introduced by the new one-way costs shifting regime.
This talk is aimed at firms and fee earners with experience of defending fraud claims and who want to utilise every weapon in the litigation armoury to defeat such claims at an early stage in an efficient and cost-effective manner.
Both speakers have extensive experience of fraud litigation and the use of interlocutory ambushes.
There will be an opportunity for questions and discussions afterwards to exchange real-world experience of combating the menace of fraudulent claims.
