Property #Brew – Waiver and relief: did Lord Neuberger always get it right?

Peter Petts and Jamal Demachkie discuss two tricky issues from the law of forfeiture, which often lead to confusion:

  • Whether demands for rent should always waive the right to forfeit; and
  • Whether a tenant need pay all rent arrears to obtain relief from forfeiture

Both topics are considered in Peter and Jamal’s recent publication, Forfeiture of Leases published by the Law Society.

This session was moderated by Gemma de Cordova.
