In partnership with TL4, Frederico Singarajah will moderate a panel discussion, featuring Phillip Patterson, looking at a range of different options available to those seeking to use powers and procedures in England and Wales to obtain evidence in support of foreign proceedings. By reference to their own experiences of using these powers, the panel will identify the pros and cons of the various options available and will offer insights as to how to obtain the best and most probative evidence for the benefit of those foreign proceedings.
The discussion will focus on:
• Letters of Request under the Hague Convention on the Taking of Evidence Abroad in Civil or Commercial Matters 1970 and CPR Part 34;
• Norwich Pharmacal and Bankers Trust applications;
• Powers under the Insolvency Act 1986.
