All of our barristers have an understanding of the law relating to costs. The recovery of costs is an important part of all actions. However we also have costs specialists who have experience in all aspects of costs law and have appeared in costs disputes in all courts up to and including the Supreme Court.
We have significant experience of detailed assessments, Solicitors Act applications, third party funding, ATE and BTE policies, CFAs, CCFAs, DBAs and other innovative funding arrangements. We are regularly instructed to advise and appear in relation to important points of principle on detailed assessments and on appeals. We have considerable experience of drafting bespoke funding agreements including one that is used by one of the largest third party funders.
We have appeared in a number of important wasted costs matters often instructed on behalf of the solicitors’ insurers. Similarly we have extensive experience of non-party costs applications including applications against company directors, associated companies and funders.
Our costs experts also act in professional negligence claims arising out of costs issues such as the failure to consider other means of funding or the failure to advise as to the availability of ATE. We also advise in relation to disciplinary proceedings that relate to costs matters.
