The Hardwicke Clinical Negligence & Personal Injury Team invite you to join them in an informal Zoom chat to discuss recent developments in fatals cases. Topics to be covered include:
- Extending bereavement damages to established co-habitees, following the declaration of incompatibility in Smith v Lancs Teaching Hospitals NHS and the Fatal Accidents Act 1976 (Remedial) Order2020;
- Practical tips for bringing and defending financial dependency claims in the light of recent cases;
- The appropriate approach to ‘wealth creator’ cases, drawing on Rix v Paramount Shopfitting Co Ltd[2020] EWHC 2398;
- Where the deceased would have cared for the home and the foster children whilst the Claimant wife continued to work: Witham v Steve Hill Ltd [2020] EWHC 299.
This session will be hosted by Charles Bagot KC and Aneurin Moloney and moderated by Colm Nugent.
