Community care overview
We act for both claimants and public authorities in disputes over all aspects of public service and care provision including needs assessment, children and adult services, capacity and mental health issues, continuing health care and consequential human rights issues.
We advise claimants seeking care services from local authorities and primary care trusts, and defends claims brought against public authorities including claims under the Equality Act 2010. This includes provision for children, young adults and vulnerable or disabled adults. This often involves instructions on the assessment duties and questions about changes to provision, the nature of disability and the proper consideration of care services for disabled people.
We are also instructed following complaints to the Local and Central Government Ombudsman, and complaints to the Care Quality Commission and has experience of the regulatory regimes applicable to care services and claims involving registration and deregistration of care homes/other institutions covered by the Care Standards Tribunal.
