Costs Brew: Part 36 Offers

In this first session of Gatehouse Chambers’ Junior-To-Junior (“J2J”) Costs Series, Jake Rowley and Charlotte Wilk consider key issues facing junior practitioners when it comes to Part 36 offers and their interaction with the new fixed costs regime.

This session looks at the formal requirements of making a valid Part 36 offer; when and how a Part 36 offer can be varied or withdrawn; the various cost consequences which arise in the Fast and Intermediate Tracks when offers are accepted, or the parties push on to trial; and the concept of ‘mistake’ as it related to Part 36 offers.
