Colm Nugent successful in first High Court case ruling on the duties of McKenzie Friends: Wright v Troy Lucas & Rusz

18 Mar 2019

Colm Nugent was successful last week in persuading the court to order a McKenzie Friend (Mr Rusz operating through the firm of Troy Lucas) to pay  more than £260,000 by way of compensation after causing the Claimant, Mr Wright, to miss out on damages and incur huge costs in a medical negligence case.  This is the first time that the High Court has ruled on the duty owed to the public by unqualified advisers, known as McKenzie Friends.

It follows the concern expressed recently by the Lord Chief Justice about the growth of McKenzie Friends as they are unregulated and require no qualifications or insurance.

There has also been considerable press interest in this case eg in The Law Society Gazette and The Times
