In this session we will be exploring the practical application of the CIGA 2020 to winding up petitions. How does the court determine whether the grounds of the petition arise from the financial effects of coronavirus on a company? In what circumstances will a winding up order made between 27 April and 28 June 2020 be void by reason of para 7 Sch 10? Simon Kerry, Katrina Mather and Sarah Clarke will discuss the principles which have emerged from reported decisions and share their own experiences of the court’s approach in practice. Jonathan Titmuss will chair the session.
