The aim of this event is to discuss the review of arbitration legislation in various Latin American jurisdictions through the lenses of the English experience reviewing the 1996 Arbitration Act. The panel will address salient topics addressed by the 2025 Arbitration Act and consider whether similar amendments would be appropriate and useful in the selected Latin American jurisdictions.
Overall, this event offers an opportunity to reflect on the modernisation of arbitration legislation, identifying global issues and discussing how regional idiosyncrasies might motivate different responses to similar phenomena.
The main discussion in the event will be conducted in Spanish but participation and questions in English are equally welcome.
Topics Include:
- Arbitrators’ duty to disclose
- Law governing arbitration agreements
- Summary disposition by the arbitral tribunal
- Level of review of arbitral decisions on jurisdiction by national courts (annulment and recognition & enforcement)
