IVAs have, for some years, been more common than bankruptcies, and are often viewed as a more appealing alternative by debtors. However, the success of an IVA depends on the particular circumstances of the debtor, the attitude of their creditors, and proper communication between the two camps. In this Brew, Ryan Hocking and Adam Smith-Roberts will discuss some of the difficulties which can arise in relation to asset disclosure, formulation of proposals, the role of an Insolvency Practitioner in relation to an IVA, and the ways in which some of these difficulties can be resolved by debtors and creditors alike.
